Legal context
The Respect@Work Learning Plan supports organisations in meeting their obligations under Australia’s workplace sexual harassment laws, including the Sex Discrimination Act 1984 (SDA) and the Fair Work Act 2009 (FWA). It aligns with the Respect@Work report recommendations and reflects the positive duty introduced in 2022 under the Anti-Discrimination and Human Rights Legislation Amendment (Respect at Work) Act.
Under these reforms, employers are no longer expected to only respond to complaints—they are legally required to take proactive and preventative steps to eliminate workplace sexual harassment, discrimination, and related misconduct.
